Terms of Use

Last updated

These are the terms governing use of the Machete Cards website and the software subscription. They say what you can expect from us, what we expect from you, and how the commercial relationship works.

Who you are agreeing with

These terms are between you and Shipyard Labs LLC, doing business as Machete Cards. They cover both sides of what we run: this website, where card owners submit collections, and the software subscription that card shops use to price, list and sell their inventory. By using the site or the software, you accept these terms.

Who may use the service

You must be at least 18 years old, or the age of majority where you live, to create an account or submit a collection. The software is offered for use in running a card business or managing a collection, and you may only accept these terms for a business if you have the authority to bind it.

Use of this site

This site exists to help card owners submit collections for evaluation, consignment inquiry, and related services. You agree to provide accurate information and to use the forms only for genuine inquiries.

Submissions are not offers

Submitting a collection through this site is not an offer by you or by Machete Cards. Any purchase or consignment happens only through a subsequent, explicit agreement between both parties.

Accounts and workspaces

Creating an account creates a workspace and makes you its owner. You are responsible for your credentials, for who you invite, and for what the people you invite do in it. Keep the email on the account reachable — it is how we reach you about billing and security.

Subscriptions and billing

Paid plans are listed on the pricing page and are billed in advance through Stripe, monthly or annually, and renew automatically at the then-current price until cancelled. Plan allowances — such as included seats and AI card scans — reset each billing period and do not roll over. Taxes are added where they apply. We will give notice before a price change takes effect for an existing subscriber.

Cancelling, and what happens to your data

You can cancel at any time from the billing screen in your workspace, which opens Stripe's billing portal; if you cannot finish it there, ask us through the contact page and we will cancel it for you. Cancellation stops the next renewal; the workspace keeps its plan until the end of the period already paid for, and then reverts to the free tier. Partial periods are not refunded by default — if a charge is wrong, tell us and we will make it right. You can export your workspace data yourself from the workspace settings, before or after cancelling. A workspace you close is retained for 30 days and then permanently deleted, except records we must keep for accounting or legal reasons.

Who owns what

Your workspace data — your inventory records, photos, prices, customers and orders — is yours. You grant us the licence needed to host it, process it and show it where you have asked us to, including on your storefront and on any marketplace you connect. We do not sell it and we do not use one shop's data to give another shop an advantage. We do use aggregate, non-identifying usage information to improve the service. The software, the site and the Shipyard Labs LLC name and marks stay ours.

Your customers' data

When your storefront or point of sale collects information about your customers, you are responsible for it: for collecting it lawfully, for answering your customers' privacy requests, and for the promises your own policies make. We process that data only to provide the service to you and on your instructions, we do not use it for our own purposes, and the workspace settings give you the tools — export and per-customer erasure — to meet those obligations. If a customer's privacy request reaches us directly, we will refer it to you and help you comply.

Acceptable use

Do not use the service to sell counterfeit or stolen goods, to misrepresent a card's identity, condition or grade, to break a marketplace's rules with an account you connect, to scrape or resell our catalog and pricing data, to attack or overload the platform, or to reach another shop's data. Automated access is limited to our published API within its rate limits. We can suspend or terminate a workspace that does any of this, and we will tell you why.

Services you connect

Connecting eBay, Stripe or another account authorises us to act on that account on your behalf for the features you use. Those services have their own terms, and your relationship with them is your own. Payments on your storefront settle to your own Stripe account: you are the merchant of record for your sales, and refunds, chargebacks and tax obligations for those sales are yours. Third-party market and catalog data shown in the product is provided as-is under the terms of the source, and may be delayed, incomplete or wrong. It is for your own use inside the product and may not be republished, redistributed or offered onward as a data feed.

Availability and changes to the service

The service is provided as-is, without an uptime guarantee or a support-response commitment. We may change or remove features; where a change materially reduces what you pay for, we will give notice. Keep your own records of anything you cannot afford to lose.

Intellectual property

The Machete Cards name, logo, and site content belong to Shipyard Labs LLC. Card game and sports league names and marks referenced on this site belong to their respective owners; no affiliation is implied.

Disclaimers

Content on this site is informational and provided as-is, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Market values, price estimates, AI card identifications and condition estimates are informational tools, not appraisals or grading opinions — verify anything you are about to rely on. Market commentary is not financial advice, and evaluations described here are not guarantees of any price or outcome.

Limitation of liability

To the fullest extent the law allows, Shipyard Labs LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from the site or the service. Our total liability for all claims arising out of the service is limited to the amount you paid us for it in the twelve months before the claim arose, or one hundred dollars if you have paid nothing. Some jurisdictions do not allow certain of these limits, so parts of this section may not apply to you; nothing in these terms limits liability that cannot lawfully be limited.

Indemnification

If you use the service to run a business, you agree to defend and indemnify Shipyard Labs LLC against third-party claims arising from the goods you sell, the data you collect from your customers, or your breach of these terms.

Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and any dispute that reaches a court belongs in the state or federal courts located in Florida. Before either of us files anything, we agree to try to resolve the dispute informally: write to sales@machetecards.com describing the problem, and we will have sixty days to work it out with you.

Changes

These terms may be updated, and the effective version will always be the one published on this page, identified by the date at the top. If a change materially reduces your rights, we will notify account holders by email before it takes effect; continuing to use the service after that is acceptance of the change.
